📜 Terms of Use

These Terms of Use (“Terms”) govern your use of the mobile application Magic Eraser (the “App”), provided by Umar Bin Masood (“we”, “us”, or “our”).

By downloading or using the App, you agree to these Terms. If you do not agree, please do not use the App.

1. License

We grant you a limited, non-exclusive, non-transferable, revocable license to use Magic Eraser on your personal devices for your own personal, non-commercial use.

You may not:

Copy, modify, or distribute the App

Reverse engineer or attempt to extract source code (except where allowed by law)

Rent, sell, or sublicense the App

Bypass or interfere with any security or technical protections

2. User Content (Your Photos)

You remain the owner of all photos and images you import into the App (“User Content”).

You are responsible for:

Making sure you have the legal rights to use and edit the images you import

Ensuring your use follows all applicable laws and third-party rights (for example, copyright, trademarks, privacy, and publicity rights)

You agree not to use the App to create, edit, or share content that is:

Illegal or infringing

Hateful, violent, or abusive

Sexually explicit or otherwise inappropriate under App Store rules

Misleading or used for harassment or impersonation

You must only use the App with content that you own or are fully authorized to modify.

You must not use the App to remove logos, text, or other markings from content you do not have the right to edit.

We may limit or block access if we believe the App is being misused.

3. AI Features and Results

Magic Eraser provides AI-powered image tools such as:

Retouch / remove unwanted elements (for example, people, objects, text, or other items the user selects)

Background removal and adjustment

Face swap (placing a face from one user-selected photo into another user-selected photo)

Text/logo overlays and other visual effects

This tool is a general-purpose editor and does not bypass any DRM or technical copy-protection system, and the App does not provide any copyrighted or licensed content itself.

You understand and agree that:

AI results may sometimes be imperfect, unexpected, or inaccurate.

We do not guarantee any particular outcome, style, or quality.

You are fully responsible for how you use any generated or edited content, including where and how you share it.

You are responsible for obtaining consent if you use images of other people (for example, using face swap with someone else’s photo).

4. In-App Purchases, Subscriptions, and Credits

The App may offer:

Subscriptions (for example, weekly, monthly, or yearly plans)

Free trials for some plans

A credit system inside the App, where certain AI actions consume credits

4.1 Payments

All payments are handled by Apple’s App Store under Apple’s terms and conditions.

We do not handle or see your full payment card details.

4.2 Auto-renewal

Subscriptions generally renew automatically at the end of each billing period unless you cancel.

You can manage or cancel your subscription in your Apple ID account settings.

Deleting the App from your device does not cancel your subscription automatically.

4.3 Credits

Certain AI tools (for example, retouch, background removal, face swap, etc.) may consume credits.

Credits may be included as part of free trials or active subscriptions.

Credits have no cash value, are non-refundable, and are non-transferable.

4.4 Refunds

Refunds are managed by Apple according to App Store policies.

If you want a refund, you must request it through Apple Support or the App Store, not directly from us.

5. Intellectual Property

All rights in the App itself (including software, design, logos, text, and other materials) are owned by Umar Bin Masood or our licensors.

You may not:

Use our name, logo, or branding in a way that suggests endorsement or partnership without our written permission.

You own your User Content, but you grant us a limited license to process it as needed to operate the App, for example:

Sending it to AI/image-processing models (such as our cloud providers)

Generating the requested edited result

Returning and displaying the result to you inside the App

We do not acquire ownership of your photos.

6. Disclaimer of Warranties

The App is provided “AS IS” and “AS AVAILABLE”, without warranties of any kind, to the fullest extent permitted by law.

We do not guarantee that:

The App will be error-free, secure, or always available

AI features will work perfectly in every case

Any generated or edited result will fit your specific purpose or expectations

You use the App at your own risk.

7. Limitation of Liability

To the maximum extent permitted by law, we are not liable for:

Any indirect, incidental, special, or consequential damages

Loss of data, images, revenue, or profits

This includes any issues arising from:

Your use or inability to use the App

AI results or edits generated by the App

Actions or failures of third-party services (for example, ads, analytics, payment providers, AI processing providers)

If we are found liable despite the above, our total liability will be limited to the amount you paid for the App and in-app purchases in the 12 months before the claim (or the minimum higher amount required by applicable law).

8. Termination

You may stop using the App at any time by uninstalling it.

We may suspend or terminate your access to the App if:

You violate these Terms or applicable laws

We are required to do so by law or by a third-party platform

We decide to discontinue the App

Termination does not automatically entitle you to a refund, except as required by Apple’s policies or local law.

9. Governing Law

These Terms are governed by the laws of Pakistan, without regard to conflict-of-law rules.

If any part of these Terms is found invalid or unenforceable, the remaining parts will continue in full force and effect.

10. Changes to These Terms

We may update these Terms from time to time. When we do, we will update the “Last updated” date at the top.

By continuing to use the App after changes become effective, you agree to the updated Terms.
